Will the Texas Shooting Prompt Action From Trump’s School Safety Commission?

Education Week logoEarlier this year, shortly after 17 students and teachers were killed at Marjory Stoneman Douglas High School in Parkland, Fla., President Donald Trump created a school commission, led by U.S. Secretary of Education Betsy DeVos, to explore solutions.

And now that there has been another deadly school shooting, at Santa Fe High School in Texas, educators, parents, and others, including advocates in Washington and folks on social media, are wondering just what the commission has been up to since its inception in early March.

Besides DeVos, the commission includes Attorney General Jeff Sessions, Secretary of Health and Human Services Alex Azar, and Secretary of Homeland Security Kirstjen Nielsen. It has had one organizational meeting, on March 28. By contrast, there have been seven school shootings since the one in Parkland, Fla., according to Education Week’s tracker.

Separately, DeVos met May 17 with experts and those personally affected by past school shootings. That meeting was not open to the public or press, but has been posted online here…

New federal data on bullying, discipline, and school safety should prompt tough questions about why certain groups of students are unfairly singled out. Could it also prevent Education Secretary Betsy DeVos from rescinding Obama-era guidance on school discipline?  Today’s Federal Flash addresses that question, highlights new people taking over top positions at the U.S. Department of Education, and covers interesting comments on education coming from top Republicans on Capitol Hill.

On Tuesday the U.S. Department of Education released the 2015-2016 Civil Right Data Collection or CRDC, a biennial snap shot of data on bullying, discipline, and school safety among other items.

The data shows that black students and students with disabilities are suspended and arrested far more often than their peers. Given the information, many are hoping this will prevent the department from rescinding Obama-era guidance on school discipline that was designed to address those problems.

The data also confirms racial disparities across students when it comes to success in science, technology, engineering and math courses.  For example, 85 percent of white eighth graders who were enrolled in Algebra I passed the course, compared to only 72 percent of Latino students and 65 percent of black students. Among Native American students and students of two or more races, fewer than 50 percent passed the course.

The data also show that high schools with high percentages of black and Latino students are less likely to offer advanced math and science courses like calculus, physics, chemistry and advanced math.

In other news from the Education Department, several empty positions have been filled. On April 18, the Senate confirmed Carlos Muñiz to serve as the Education Department’s top lawyer.

In his role as General Counsel, Muñiz will be charged with tackling some of the stickiest legal issues confronting the Department including determining whether states are complying with the Every Student Succeeds Act (ESSA), deciding whether to rescind the school discipline guidance mentioned earlier, and laying out new rules for colleges handling allegations of sexual assault on campuses under Title IX.

School Safety Forum Held by Florida Senators Highlights Prevention, Security

Education Week logoWashington, DC — A school safety forum on Capitol Hill hosted by Florida’s U.S. senators focused on how to help students head off threats from their peers, and on improving security measures for schools, among other topics.

Sen. Bill Nelson, a Democrat, and Sen. Marco Rubio, a Republican, also used the event here on Wednesday to tout their support for having the federal government offer states incentives to adopt “red flag” laws that prevent those who represent a threat to themselves or others from accessing or purchasing firearms, while preserving legal protetions for those individuals. Rubio and Nelson introduced a bill to this effect, the Extreme Risk Protection Order and Violence Prevention Act, last month, after the school shooting in Parkland, Fla.

Advocates and public officials also emphasized the importance of communication at various stages to help address school violence, from making it easier for students to share their concerns with adults, to helping law enforcement respond to violent incidents more quickly.

Nicole Hockley, whose son was murdered at Sandy Hook Elementary School in Newtown, Conn., in 2012, highlighted the “Start With Hello” training program that helps children communicate with each other about their difficulties. The program is run by Sandy Hook Promise, a nonprofit group led by Hockley that works to prevent children from violence. “It sounds so simple. But the best programs are,” Hockley said.

And Indiana officials attending the session pointed to a school that’s become a model for new security measures, from bullet-resistant classroom doors to smoke bombs that can fill a hallway and disorient a school shooter. (The latter clocks in at a cost of $400,000.) Indiana Attorney General Curtis Hill said the state has emphasized “what we can do to harden our schools, but not make them a prison.”

In expressing interest in creating national school safety standards, Rubio pointed to the Americans With Disabilities Act that created national building standards to address the needs of people with disabilities. While he said the analogy to gun violence and school safety isn’t perfect, “It’s an indication of where federal policy could help over time.” He also expressed an interest in making it easier somehow for school leaders to discover “best practices” for safety, so that “they can hear from one another about what other places are doing…”

MADISON – A month ago Assembly Democrats attempted to pass Assembly Bill 65, a bill introduced by State Representative Terese Berceau (D-Madison) requiring universal background checks on firearm purchases in Wisconsin. Democratic efforts then were stymied by Assembly Republicans who, refusing to vote on background checks for gun purchases, instead pulled several procedural stunts, and ultimately gutted Democrats’ universal background check proposal.

Today, Assembly Republicans amended Assembly Bill 1031 with an amendment relating to firearm background checks that, remarkably, did nothing to address the gun show loophole or private gun sales. State Representative Melissa Sargent (D-Madison) re-released the following statement concerning Republicans’ continued refusal to adopt universal background checksin Wisconsin:

“Republicans should have to justify their actions today, and they should have to answer to every child who is afraid to go to school, every teacher who is afraid to go to work, and every family who has been affected by gun violence due to Republican inaction.

I stood with high school students from our community in the Capitol just last week while they begged Wisconsin lawmakers to take action on gun violence. And yet, based on Republicans’ theatrics this afternoon, it’s clear our kids’ pleas didn’t just fall on deaf ears, they fell on ears that just don’t give a damn

Inaction is complicity. It’s not a matter of if the next shooting is going to occur, it’s when, and it could happen in our watch in Wisconsin if Republicans don’t start acting like the adults our kids expect us to be.”

Melissa Sargent is a State Representative in the Wisconsin Assembly, representing the 48th Assembly District, which covers the east and north sides of the city of Madison and the village of Maple Bluff.

Announces primary membership, first meeting and other key details

WASHINGTON – U.S. Secretary of Education Betsy DeVos today announced new details on the Federal Commission on School Safety the President appointed her to chair. The Commission has been charged with quickly providing meaningful and actionable recommendations to keep students safe at school. Accordingly, the Commission will be comprised of department heads whose agencies have jurisdiction over key school safety issues: Secretary DeVos, Attorney General Jeff Sessions, Secretary of Health and Human Services Alex Azar and Secretary of Homeland Security Kirstjen Nielsen.

The first organizational meeting will be Wednesday, March 28 in Washington, D.C. to discuss the scope of the Commission’s work, timeline, locations for meetings and topics for field hearings.

Input from and meetings with students, parents, teachers, school safety personnel, administrators, law enforcement officials, mental health professionals, school counselors, security professionals and other related stakeholders will be critical to the Commission’s work.

Additional details on stakeholder engagement both in Washington and across the country will follow the meeting on March 28.

“Over the last several weeks, I have held meetings with parents and non-profit organizations, who in the wake of tragedy, have leapt into action and have focused on finding solutions to school violence,” said Secretary DeVos. “The Commission’s task will be to hear their ideas and the ideas of anyone who is focused on finding solutions to bolster school safety across the country. We want to highlight what’s working so that every school has access to solutions that will keep students and teachers safe.”

Attorney General Sessions had this to say about the Federal Commission on School Safety’s work, “No child should have to be afraid to go to school. That’s why President Trump has taken action to strengthen law enforcement and to protect law-abiding people from the threat of gun violence. Since last month’s tragic shooting in Parkland, the Department of Justice has taken new steps to put more law enforcement officers in schools, ban bump stocks, get better information to our background check systems, and aggressively prosecute those who lie on a background check. I am confident that, by bringing together teachers, parents, and law enforcement officers, the School Safety Commission will inform the next steps we will take to give students safety and peace of mind.”

Secretary Azar added, “It is a core responsibility of government to keep our communities, and especially our schools, safe from all forms of violence. We at HHS look forward to contributing to the work of the Commission, especially when it comes to identifying young Americans struggling with serious emotional disturbance or serious mental illness and helping them find treatment that enables them to lead healthy, fulfilling lives.”

Secretary Nielsen said, “No child should have to worry about their safety when in school. The Department’s top priority is to keep the American people safe. I look forward to working with other Commission members to advance school security, including by promoting education and community awareness of school threats, capacity building and training to guard against them, and early warning mechanisms to help intervene before threats become tragedies.”

Students, Educators and Parents March on Washington to Demand Action on Gun Violence

Hundreds of thousands took to the streets in the March For Our Lives rally against gun violence in Washington, D.C. Organized by the survivors of the massacre at Marjory Stoneman Douglas High School, it was a rally by students for students, but they were joined by thousands of educators who amplified their message — #neveragain. Hundreds of sister marches were held across the country and around the world.

Busloads of educators came from all over the country to support the Florida students and students all over the country who demand to be heard. Taking part  was a group of educators from Connecticut, where the shooting that killed 26 elementary school children and educators at Sandy Hook Elementary in Newton is still raw.

“We have to do something with our gun laws, and we have to be vigilant. Talking and talking about it doesn’t change anything and we need to act. Our kids don’t feel safe,” said Mia Dimbo, a middle school math teacher from Bridgeport as she prepared to march to the site of the rally in Washington. “We need support for mental health. We don’t have enough resources for psychologists and counselors, and there’s so much trauma our kids are dealing with. They should not be afraid when coming to school. Today I march for our kids and our teachers…”

Education leaders face challenges every day. We examine them through the lens of opportunity and strive to be proactive in solving problems before they materialize. We lead to serve, to build capacity, and to nurture hopes, dreams, and our children’s futures. Yet, we live in a time where we wake each day to a barrage of formidable responsibilities that politics and divisive behaviors only amplify. Among those are frequent acts of school violence. Many of us agonized—and continue to do so—following the Parkland school shooting, the student walkouts, and the tenuous struggle between encouraging civic activism and protecting our students’ safety. These gnaw at the essence of my being.

Faced with these challenges, we create opportunities; we shift paradigms. Despite our best efforts to make the best decisions, we will never be right in everyone’s eyes. That is the school leader’s reality. Opinions surrounding the March 14th student walkout were varied. They represented a wide range of values and beliefs. But our school district runs on consensus, so it was important to me to make the decision about the walkout together with my district colleagues. We wanted to remain true to our priorities: school safety and the education of our students.

On March 5th, we sent home a letter to the parents and guardians of the 846 students in our district’s one high school, since these were primarily the students who would be walking out. We made it clear that if students chose to exit the building, they would face consequences as defined by our district’s code of conduct. And these would be the same consequences they would face for leaving the building on any other school day…

“We have to harden our schools, not soften them up,” President Donald Trump said at a White House event days after the Feb. 14 school shooting in Parkland, Fla.

There is no evidence to support such an assertion. I know, because I’ve looked for it. I have spent close to a decade studying various aspects of American high school life, culminating last year in a book that questions whether high-security schools do students more harm than good. In Rhetoric, Embodiment, and the Ethos of Surveillance: Student Bodies in the American High School, I make a controversial suggestion: We need to lessen school security.

We may think that more metal detectors, more sniffing dogs, and more armed police officers will keep students safer. The U.S. House of Representatives overwhelmingly approved the STOP School Violence Act last week by a 407-10 vote to provide training and funding for violence prevention. The bill doesn’t allow funds to be used to provide firearms, but could fund threat assessments and crisis-intervention teams. A similar Senate bill is awaiting a vote.

The darker side of all these safety measures is that they conflate schools with prisons, engendering the school climate with fear, distrust, paranoia—and, yes, violence…

COMMENTARY: What Kind of Nation Have We Become When We Fail to Protect Our Children?

In the wake of yet another mass slaughter of innocent Americans, I am writing to implore my colleagues in both the Congress and our state legislatures to go to CNN’s website and listen carefully to the words of a young American named Cameron Kasky. You can find his declaration of principle and truth on CNN.com.

This 17-year-old student at Marjory Stoneman Douglas High School in Parkland, Florida, is demonstrating more courage, moral clarity and determination about the danger of unregulated guns in America (and, especially, the danger to us all of high-powered, military grade, semi-automatic weapons) than are many of the women and men with whom I serve.

As most Americans now know, on February 14 (Valentine’s Day), Cameron Kasky, his brother, Holden, and all of the students and teachers at their Parkland, FL, high school were forced to fear for their lives.  A deranged person had picked up a lawfully purchased AR-15, took it to the school, and methodically murdered 17 people, injuring another 14.

We also know that, in the era after the Columbine massacre of 1999 (13 dead and 24 injured), mass slaughters with semi-automatic weapons have become a harsh, terrifying and unacceptable reality of American life.

Just as we must redouble our efforts to reduce the violence in places like Chicago and Baltimore, we cannot – and we must not – forget the sense of loss and personal devastation that we felt after Virginia Tech (32 dead).  We cannot brush aside the primitive brutality of Binghamton, NY (14 dead), or Aurora, CO (12 dead), or Sandy Hook (the lives of 27 children and teachers methodically destroyed).

We must act.  Our national conscience and sense of security and self-worth cannot withstand any more breaking headlines – any more mass killings in San Bernadino, CA (14 killed), Orlando, FL (49 massacred),  Las Vegas, NV (58 killed and 546 injured), or Texas (26 killed).

Now, if you think that this partial listing of the butcher’s bill from our failure to adequately regulate semi-automatic weapons of war is incomplete, you are correct.  There is insufficient room in this newspaper to adequately remember all of the casualties from the gun violence that our nation has endured.

What should be heartening to us, however, is the determination and clarity that Cameron Kasky and young people across America are expressing in their challenge to their elected representatives, their governors and the President of the United States.

“At the end of the day,” Cameron observed in his CNN interview, “the students at my school felt one shared experience – our politicians abandoned us by failing to keep guns out of schools….”

“Our community just took 17 bullets to the heart,” he continued, “and it feels like the only people who don’t care are the people who are making the laws.”

I must agree.

There is no period of silence, no equivocating delay, no overreaching argument about the constitutional sanctity of our Second Amendment that is adequate to counterman a simple, compelling and unavoidable truth.

Cameron Kasky is speaking truth to power when he declares that, as a nation, we are failing to protect our people from this carnage.  Most unforgivable of all, we are failing to protect the lives of our school children.

Every last elected official in America, and every last citizen who voted for us (or failed to vote at all), bears a measure of responsibility for this failure and its bloody toll on human lives.  Yet, as Cameron Kasky also acknowledges, we are not all equally culpable.

“The truth,” he observed, “is that the politicians on both sides of the aisle are to blame. The Republicans, generally speaking, take large donations from the NRA and are therefore beholden to their cruel agenda. And the Democrats lack the organization and the votes to do anything about it.”

We, who have been elected to serve and protect our Constitution and the American People, can only stand before this challenge, acknowledge our failures and seek to reclaim our honor.

As a first honest step, we can acknowledge that before the federal assault weapons ban expired, it did not stop all killings, but it did significantly reduce the carnage.  We who serve in the Congress have the power, right now, to renew those protections.

The proposed Assault Weapons Ban of 2018 [H.R. 5087], sponsored by my colleague, Rep. David Cicilline of Rhode Island, now has more than 173 co-sponsors.  Senator Diane Feinstein’s companion bill [S.2095] has 29.  I, along with all of Maryland’s Democratic Delegation, am fighting for its passage.

However, in proof of Cameron Kasky’s indictment, there are no Republicans in support of these modest, protective measures, only a few Republicans support strengthened background checks, and a Republican House and Senate leadership, beholden to the NRA, is denying us the ability to even have a floor debate and up-or-down vote.

Nevertheless, I am cautiously optimistic that the will of the American People will prevail.  A recent Quinnipiac opinion poll found that 67 percent of Americans (including 43 percent of Republicans) now favor an assault weapons ban.  Even more encouraging, the young people of our nation (along with many of us who are older) are mobilizing.

This growing movement for greater safety, security and sanity in our national discussion about guns – this March for Our Lives – will be bringing upwards of 500,000 Americans to Washington, DC, on March 24th – with companion marches across the nation, including here in Baltimore.  For more information, go to https://marchforourlives.com/ on your Web browser.

Even if you can’t march on the 24th, please remember this.  Our Constitution (including its Second Amendment) was not designed to be a collective suicide pact.  It was designed to protect the safety, as well as the liberty, of the American People.

Above all else, and whatever political obstacles may be placed in our path, we must protect our nation’s children.  Our sacred oaths and honor demand that – and more.
