COMMENTARY: Teachers Are Organizing. But What About Teachers’ Unions?

This blossoming spring of teacher uprisings—marching on state capitols, winning hefty pay raises—cheers any citizen who knows that robust societies depend on vibrant schools.

But arid summers may await the nation’s educators, as the Trump-tweaked U.S. Supreme Court seems ready to eviscerate these same teacher associations who battle each day for better schools.

While hearing oral arguments in the Janus v. American Federation of State, County, and Municipal Employees Council 31 case in February, justices voiced skepticism over compulsory union dues, the life blood of local associations that mobilize the nation’s 3.2 million teachers.

Still, it’s the wildcat strikes moving across the nation—ignited mostly by young and passionate teachers—that may reshape the future of labor unions…

Education Week logoThe secretary will speak to lawmakers on the House education committee about the “policies and priorities” of the U.S. Department of Education. Compared to her predecessors, DeVos hasn’t been on Capitol Hill a lot during her roughly 16 months as education secretary, at least in terms of public appearances: She’s testified before spending committies three times, and once to the Senate education committee for her rocky confirmation hearing in January 2017. Tuesday’s hearing would be the first time she’s testified before the House committee that deals with K-12 issues.

DeVos has met privately a few times recently with lawmakers on Capitol Hill. But education committee lawmakers haven’t had the chance to ask DeVos detailed questions in public about her track record. In fact, on Friday, House committee Democrats sent out a fact sheet pointing out that her predecessors spent significantly more time testifying to Congress over comparable periods of time. In former Secretary Arne Duncan’s first 15 months, for example, he testified to Congress nine times.  

With a big House election in November coming up, Dems on Tuesday might be particularly eager to trip DeVos up during her testimony and spin what they see as embarassing sound bites into campaign ads.

So what might lawmakers ask DeVos? Democrats in particular will have pointed questions for her in the name of opposition party oversight; here are a few prominent items that might come up…

“It was a great feeling watching the returns come in!” said Jonas Knotts, a high school teacher and president of the Webster County Education Association, an affiliate of the West Virginia Education Association (WVEA). “People and educators are really starting to see the power that they possess. We have a voting bloc that, if we turn out to the polls, can outvote anybody. Teachers are realizing this. It’s something that fills us with a very empowering feeling.”

Early this spring, WVEA members kicked off what NEA President Lily Eskelsen García has called an “education spring” with a statewide, nine-day strike that brought red-shirted educators from every one of the state’s 55 counties to the state Capitol.

Their massive show of solidarity, which ended with significant pay raises for all public workers, including teachers and education support professionals, and the establishment of a state task force to address public-worker health insurance, inspired educators across the nation and has been followed by statewide educator walkouts in Oklahoma, Arizona, and Kentucky, and huge Capitol demonstrations in Colorado and North Carolina.

Now, WVEA members are modeling what happens next: They’re taking their energy and passion for public education to the ballot box. In this May’s primary races, WVEA endorsed 115 pro-public school candidates for U.S. Senate, U.S. House, and the state’s House of Delegates and Senate. Of those, 99 candidates—or nearly 90 percent—won. One state lawmaker who had called union members “free riders” was shown the door.

This is exactly what public-school educators across the nation have promised to do in the mid-term elections this November. With this latest show of union strength, WVEA members have shown how it can be done—and how good it feels.

“This election was a huge vindication for the power of the movement because, of course, the opposition was saying ‘they’re going to forget, they’re going to stay home,’” said Knotts. “But we know it’s only one victory in a long war. We have to keep up those conversations, we have to keep people engaged, we have to show them how we’re working to improve everybody’s status—from teachers to support personnel to students to communities…”

New federal data on bullying, discipline, and school safety should prompt tough questions about why certain groups of students are unfairly singled out. Could it also prevent Education Secretary Betsy DeVos from rescinding Obama-era guidance on school discipline?  Today’s Federal Flash addresses that question, highlights new people taking over top positions at the U.S. Department of Education, and covers interesting comments on education coming from top Republicans on Capitol Hill.

On Tuesday the U.S. Department of Education released the 2015-2016 Civil Right Data Collection or CRDC, a biennial snap shot of data on bullying, discipline, and school safety among other items.

The data shows that black students and students with disabilities are suspended and arrested far more often than their peers. Given the information, many are hoping this will prevent the department from rescinding Obama-era guidance on school discipline that was designed to address those problems.

The data also confirms racial disparities across students when it comes to success in science, technology, engineering and math courses.  For example, 85 percent of white eighth graders who were enrolled in Algebra I passed the course, compared to only 72 percent of Latino students and 65 percent of black students. Among Native American students and students of two or more races, fewer than 50 percent passed the course.

The data also show that high schools with high percentages of black and Latino students are less likely to offer advanced math and science courses like calculus, physics, chemistry and advanced math.

In other news from the Education Department, several empty positions have been filled. On April 18, the Senate confirmed Carlos Muñiz to serve as the Education Department’s top lawyer.

In his role as General Counsel, Muñiz will be charged with tackling some of the stickiest legal issues confronting the Department including determining whether states are complying with the Every Student Succeeds Act (ESSA), deciding whether to rescind the school discipline guidance mentioned earlier, and laying out new rules for colleges handling allegations of sexual assault on campuses under Title IX.

Betsy DeVos Loves School Choice. But You Don’t See Much of It in ESSA Plans

Education Week logoU.S. Secretary of Education Betsy DeVos is a big cheerleader for school choice. And way before she came into office, states around the country were adopting tax-credit scholarships, education savings accounts, and more.

So has all that translated into a big bonanza for school choice in states’ Every Student Succeeds Act plans? Not really.

To be sure, ESSA isn’t a school choice law. School choice fans in Congress weren’t able to persuade their colleagues to include Title I portability in the law, which would have allowed federal funding to follow students to the public school of their choice.

However, the law does has some limited avenues for states to champion various types of school choice options. But only a handful of states are taking advantage of those opportunities, according to reviews of the plans by Education Week and the National Alliance for Public Charter Schools.

School Improvement: At least 12 states say they want schools that are perennially low-performing to consider reopening as charter schools to boost student achievement. Those states are Arizona, Florida, Georgia, Indiana, Louisiana, Minnesota, New Mexico, Nevada, Rhode Island, Tennessee, Texas, and Utah.

Education Week logoThe U.S. Department of Education has started informing a small group of states that they will have to make changes to the way they test students with severe cognitive disabilities, because of accountability changes brought about by the Every Student Succeeds Act.

Federal law permits students with the most severe cognitive disabilities to take an alternate assessment aligned to alternate achievement standards. Under the No Child Left Behind Act, the predecessor to the Every Student Succeeds Act, that assessment could be in the form of a portfolio, or collection of student work. But ESSA states that student assessments for accountability can only “be partially delivered in the form of portfolios, projects, or extended performance tasks,” meaning that states relying solely on portfolios have to make a change.

Officials at the U.S. Department of Education said that only a few state education agencies are expected to be affected by the requirement, and that so far, Georgia and Puerto Rico have been notified that they will have to change their testing procedures.

Allison Timberlake, Georgia’s deputy superintendent for assessment and accountability, said the state is reviewing the law and regulations but doesn’t anticipate a problem. The state is developing a new alternate assessment that will require students to perform standardized tasks, rather than relying solely on teachers collecting evidence of student performance.

“As we develop the new alternate assessment, we will review it to ensure it meets all federal requirements,” Timberlake said…

Education Week logoThe selection of Johnny Collett, confirmed in December to oversee special education for the U.S. Department of Education, was a rare point of agreement between the Trump administration and the disability-advocacy community.

U.S. Secretary of Education Betsy DeVos was tripped up on disability-policy questions during her confirmation hearing last year, and her staunch support of school choice options has left some advocates worried that parents may not understand that choosing private schools means losing the rights guaranteed under the Individuals with Disabilities Education Act.

But Collett’s special education bona fides were not in question: A former special education teacher, he has served as a special education director for Kentucky and was the director of special education outcomes for the Council of Chief State School Officers.

Four months into his tenure, Collett, the assistant secretary for the office of special education and rehabilitative sevices, is trying to position the department as a supportive partner to states.

In an interview with Education Week, Collett discussed a wide range of issues involving special education responsibilities, including the Education Department’s oversight of the Every Student Succeeds Act; discipline and discrimination; school choice and students with disabilities; and the department’s leadership role.

He talked about the complex interplay special educators face between complying with federal law, supporting high expectations for all children, and recognizing each student’s individual educational needs.

Education Week logoThe Every Student Succeeds Act is supposed to bring about a big change in school improvement. The law says states and districts can use any kind of interventions they want in low-performing schools, as long as they have evidence to back them up.

But the provision has some experts worried. They’re concerned that there just aren’t enough strategies with a big research base behind them for schools to choose from. These experts also worried that district officials may not have the capacity or expertise to figure out which interventions will actually work.

Districts, they’ve said, may end up doing the same things they have before, and may end up getting the same results.

“My guess is, you’ll see a lot of people doing the things they were already doing,” said Terra Wallin, who worked as a career staffer at the federal Education Department on school turnaround issues and is now a consultant with Education First, a policy organization that is working with states on ESSA implementation. “You’ll see a lot of providers approaching schools or districts to say, ‘Look, we meet the evidence standard,'” Wallin said…

Education Week logoFor two decades, as part of repeated research studies, thousands of participants from diverse backgrounds have watched the same video of college students playing basketball in a circle. Participants are told to count how many times the students wearing white shirts pass the basketball. Stunningly, roughly half of the participants become so distracted trying to count the passes that they completely miss something extraordinary: a student dressed in gorilla suit who walks into the middle of the scene and thumps her chest before walking out of the frame nine seconds later.

In the world of neuroscience, this phenomenon of being oblivious to the obvious is called “inattentional blindness.” This occurs any time we as human beings fail to notice a fully visible but unexpected object because our attention was on another task, event, or activity.

Inattentional blindness is an important concept to keep in mind now that the 2017 National Assessment of Educational Progress results for reading and mathematics for 4th and 8th grades have been released.

As many feared, results were extremely disappointing across the board. Nevertheless, there are already reams of analysis of certain subgroups highlighting the stubborn achievement gaps within the mesmerizing categories of students’ race and family income. For example, despite the fact that only 37 percent of all 4th graders were at or above “proficient”—further evidence that poor reading performance crossed all racial boundaries—the dominant reaction to the scores continues to focus on the black-white achievement gap…

Betsy DeVos Has Been Scarce on Capitol Hill; Why Is That? – Politics K-12 – Education Week

Education Week logoU.S. Secretary of Education Betsy DeVos hasn’t testified before the House or Senate education committees since becoming secretary more than a year ago—and Democrats aren’t happy about that.

For one thing, it’s a departure from the record of her recent predecessors, each of whom had appeared before the two education committees at least once—and in many cases, more often—by this point in their tenures. And even when you widen the lens to look at other committees on Capitol Hill, DeVos is still behind the pace of her predecessors.

All in all, DeVos has testified before Congress just four times so far, including her confirmation hearing in January of last year, and three education spending committee appearances.

That’s not to say DeVos is dodging lawmakers. The party in control of Congress—in this case, the GOP—gets to decide when a cabinet secretary appears before Congress. “Every time the Secretary has been called up to testify she has made herself available to do so,” said Elizabeth Hill, a spokeswoman for the department.

Still, top Democrats on the House and Senate education committees—Rep. Bobby Scott of Virginia and Sen. Patty Murray of Washington—are not happy that they haven’t gotten a chance to hear from DeVos directly. They have big concerns about the way DeVos is implementing the Every Student Succeeds Act, her school choice agenda, and what they see as her rollback of Obama-era civil rights protections. They want to question her about those issues in person.

House Republicans say they fully intend to have DeVos speak to the committee, they’ve just run into scheduling conflicts.
