Nominee for Top Education Dept. Attorney: I’d Tell Officials to Follow ESSA

Education Week — The nominee to be the U.S. Department of Education’s lead attorney, under questioning from the top Democrat for education in the Senate, said he would tell states and Secretary of Education Betsy DeVos to follow the Every Student Succeeds Act.

His statement follows comments from DeVos that states should push to get as much flexibility as possible under the law.

In his Tuesday confirmation hearing before the Senate education committee, Carlos Muñiz, an attorney in private practice who formerly worked for former Florida Gov. Jeb Bush and Florida Attorney General Pam Bondi, gave a narrow answer about ESSA oversight, telling Sen. Patty Murray of Washington that, “My advice to states would be to follow the law. … My job would be to advise her as to what the law requires, advise her as to what her discretion might be.”

During our exclusive Q&A with DeVos last week, the secretary said that under ESSA, “I’m encouraging states to do so and not to err on the side of caution, but to really push and go up to the line, test how far it takes to go over it.”

He took a similar line with Sen. Lamar Alexander, R-Tenn., who asked Muñiz if DeVos should follow ESSA’s clear prohibitions on the secretary’s role in issues such as state’s long-term academic goals. Muñiz responded that he would be “scrupulous” in advising officials to follow the law.

Sen. Al Franken, D-Minn., meanwhile, raised the issue of the Trump administration’s decision to scrap Obama-era guidance on transgender student rights in schools.

After Muñiz said he agreed with Franken that LGBT students deserve to go to school in a safe and respectful environment, the senator asked him if Trump met the expectations of LGBT students and their families when he scrapped that guidance.

Muñiz responded it was his understanding that the move was intended “to give the new administration the opportunity to study the law and study those issues.”

“The department has been clear that all students have a right to be free of sex discrimination in schools that receive federal funds,” Muñiz said.

During her own testimony to Congress, DeVos came under fire for how she described the responsibilities of private schools with respect to racial and sexual discrimination.

Few Nominees So Far

In prepared remarks before the committee, Muñiz said his previous work in Florida “have taught me the importance of the rule of law.”

And Muñiz also stressed that he would use his independent legal judgment at the department, telling senators, “My ultimate duty will be to the law, not to any individual or objective.”

Muñiz is just the second nominee for the Education Department to come before the Senate committee, following DeVos herself. Peter Oppenheim, a former aide to committee chairman Sen. Lamar Alexander, R-Tenn., was confirmed as the department’s liaison to Congress earlier this year. Several key positions for K-12 at the department still do not have Senate-confimed appointees.

House OKs Bill to Slash Education Budget as School Choice Push Loses Out

Education Week — The House of Representatives voted Thursday to approve an education funding bill that would cut about $2.3 billion from the U.S. Department of Education, a roughly 3.5 percent reduction from the agency’s current budget of $68.4 billion.

The House bill funding the department for fiscal year 2018 would eliminate $2 billion in Title II funding for teacher training and class size reduction, and cut $100 million from current spending on after-school aid. (More on that last issue here.) The legislation, which was approved by a 211-198 vote, keeps Title I funding for disadvantaged students flat at about $15.4 billion, and also includes a $200 million increase for special education. It also rejects prominent elements of President Donald Trump’s budget proposal, most specifically on school choice—more on that below.

The House spending bill, which provides $66.1 billion to the Education Department as part of a broader $1.2 trillion spending package for various government agencies, must be reconciled with the Senate legislation. Unlike House lawmakers, Senators in charge of the appropriations process have so far, in the subcommittee and committee that oversee K-12 spending respectively, voted to increase spending slightly at the Education Department

Here’s What States Are Doing With Their ESSA Block Grant Money

For decades, district leaders have been clamoring for more say over how they spend their federal money. And when the Every Student Succeeds Act passed back in 2015, it looked like they had finally gotten their wish: a brand-new $1.6 billion block grant that could be used for computer science initiatives, suicide prevention, new band instruments, and almost anything else that could improve students’ well-being or provide them with a well-rounded education.

But, for now at least, it looks like most district officials will only get a small sliver of the funding they had hoped for, putting the block grants’ effectiveness and future in doubt.

The Student Support and Academic Enrichment Grants, ”or Title IV of ESSA, ”only received about a quarter of the funding the law recommends, $400 million for the 2017-18 school year, when ESSA will be fully in place for the first time…

Civil Rights Commission Launches Investigation Into Ed. Dept., Other Agencies

The U.S. Commission on Civil Rights, an independent agency charged with advising Congress and the President, has launched a two-year investigation into civil rights practices at several federal agencies under the Trump administration, including the U.S. Department of Education.

The commission, which made the move on Friday, plans to take a closer look at civil rights enforcement across the government, including the Departments of Justice, Health and Human Services, Labor, and Housing and Urban Development.

The panel is particularly concerned that the Trump administration is seeking to cut the budgets of the civil rights arms of these agencies. And it is bothered by statements by some cabinet officials, including U.S. Secretary of Education Betsy DeVos, that the commisssion says may demonstrate that the Trump administration isn’t going to take civil rights enforcement seriously. (DeVos is, in fact, the only cabinet official the statement mentions by name)…

NATIONAL: Governors to Congress: Don’t Shortchange Us on ESSA, Special Ed.

With President Donald Trump’s proposed budget for the next fiscal year now on the table, the nation’s governors have a message for Congress: Think carefully before you cut key education programs.

In a May 25 letter to the four top federal lawmakers responsible for funding the U.S. Department of Education, Gov. Brian Sandoval, R-Nev., and Gov. Jay Inslee, D-Wash., urged Congress to “prioritize investments” in programs related to the Every Student Succeeds Act, career and technical education, and elsewhere.

“Governors’ message to Congress is clear: There must be careful consideration as to how to appropriately invest in these types of programs (and many others),” Sandoval and Inslee wrote. “Otherwise, cuts and changes not carefully considered could lead to a deterioration of state budgets.” Sandoval is the vice chairman of the NGA…

Congress Tossed Obama’s ESSA Rules; How Could Betsy DeVos Redo Them?

Now that Congress has gotten rid of the Obama administration’s accountability regulations for the Every Student Succeeds Act, the Trump-controlled Education Department technically can start the regulation process from scratch, but it is prohibited from writing “substantially similar” rules until new legislation is passed.

That begs two questions: One, will the Trump administration re-regulate? And two, what exactly would constitute “substantially similar” regulations to the Obama ones that Congress just tossed? (Spoiler: Congress may essentially get to decide whether any new Trump regulations are too much like the Obama regulations to pass muster. More below.)

National Voucher Program Could Bleed Many School Districts Dry, Report Says

If President Donald Trump and Secretary of Education Betsy DeVos get a national voucher program approved by Congress, it could be a crippling if not fatal blow to many of the small and medium-size school districts around the country, according to a new Center for American Progress report.

The left-leaning Washington think tank issued a report last Friday, “Vouchers Are Not a Viable Solution for Vast Swaths of America,” that examined the impact of a nationwide voucher program on three different classifications of districts based on the number of schools. In 85 percent of the 11,200 districts the report considered (excluding regional education agencies and charter schools), specifically those where there are eight or fewer schools, vouchers are either “highly unlikely” to work or “may not work,” the report…
