Four Things to Watch For in the Trump School Safety Report

A federal panel led by U.S. Secretary of Education Betsy DeVos that’s charged with making policy recommendations on school shootings in the wake of the massacre at Majory Stoneman Douglas High School last Valentine’s Day promised to have its report out by the end of the year. That means we will see the commission’s report any day now. Education Week logo

So what do we already know about what may be in it? And what should we be watching for? Here’s your quick preview.

The report will almost certainly call for scrapping the Obama administration’s 2014 guidance dealing with discipline disparities. So what happens next?

Almost every advocate watching the commission believes it will recommend ditching Obama guidance, jointly issued by the U.S. Departments of Education and Justice. (The Washington Post reported that this is a for-sure thing last week.) The directive put schools on notice that they may be found in violation of federal civil rights laws if they enforce intentionally discriminatory rules or if their policies lead to disproportionately higher rates of discipline for students in one racial group, even if those policies were written without discriminatory intent. You can read about the arguments for and against the guidance here.

The big question will be, how do school districts react to the change? How many will decide to keep using the practices they set up to respond to the guidance, which supporters say has helped school districts revise their discipline policies to benefit of all kids? And how many will decide to make changes, in part because some educators say the guidance has hamstrung local decision-making on discipline? And will Democrats in Congress, who will control the House as of January, move to somehow formalize the guidance in law? It’s unlikely that would pass a Republican-controlled Senate, but it would send a message and keep the debate going in Washington.

What does the report say about arming teachers and about guns in general?

President Donald Trump said that the massacre at Stoneman Douglas might not have been as bad if educators had been armed. “A teacher would have shot the hell out of him before he knew what happened,” Trump said, referring to Nikolas Cruz, the former student who is accused of the slayings.

Since this is Trump’s commission, after all, it’s hard to imagine the report would come out against arming teachers. But it’s an open question how strong the language will be on this topic. Will the report encourage districts to arm educators, and point out that, under the department’s interpretation of the Every Student Succeeds Act, federal funds can be used to arm educators? U.S. Secretary of Education Betsy DeVos said that the country’s higher education system is in “crisis” thanks in part to a “government takeover of the student lending system” put in place by the Obama administration. But her contention was quickly fact-checked by a former GOP Senate staffer and other higher education experts. Education Week logo

“Our higher ed system is the envy of the world, but if we, as a country, do not make important policy changes in the way we distribute, administer, and manage federal student loans, the program on which so many students rely will be in serious jeopardy,” DeVos told the Federal Student Aid Training Conference in Atlanta in prepared remarks on Tuesday “Students are taking out tens of thousands of dollars in debt but many are misinformed or uninformed as to the implications of taking on that debt and their responsibilities to pay it back.”

Student debt, she said, is now 10 percent of national debt. “The student loan program is not only burying students in debt, it is also burying taxpayers and it’s stealing from future generations,” she said.

DeVos offered solutions for ballooning student debt, including giving students the opportunity to pursue the postsecondary path that’s right for them, even if that’s not a four-year college degree. She also called for boosting “innovation.” And she appeared to take a swipe at the free-college movement, whose champions include Sen. Bernie Sanders of Vermont, the 2016 Democratic presidential candidate.

“Nothing is free,” DeVos said. “Someone, somewhere ultimately pays the bills.”

Before she was even sworn in as Education Secretary, Betsy DeVos emerged as one of the most controversial members of the Trump Administration. Her confirmation required a historic tie-breaking vote from Vice President Mike Pence after every Senate Democrat and two Senate Republicans voted against her. In the months since, like many others in the Trump Administration, DeVos has set about rolling back Obama-era policies, from Title IX guidance on campus sexual assault to regulations on for-profit colleges. She quickly found support from conservatives who had backed her previous work as a school choice advocate, but she struggled to build broad national support for her initiatives. DeVos, a prominent Republican donor, faced criticism from Democrats, teachers’ unions and civil rights advocates, many of whom noted that she did not have a background as an educator.

It would be an understatement to suggest that DeVos’ first year alone has sparked a number of controversies, some of which include:

  • In September (2017), DeVos rolled back controversial Obama-era guidance on how universities should handle sexual assault complaints on campus. The 2011 guidelines had instructed universities to use a “preponderance of the evidence” standard when adjudicating sexual assault complaints instead of the “clear and convincing evidence” standard, which requires a higher burden of proof and was used by some schools at the time.
  • DeVos stoked further controversy when she held meetings on campus sexual assault in July (2017), speaking with victims of sexual assault as well as students who say they’ve been falsely accused. Coupled with the acting head of the department’s Office for Civil Rights assertion that 90% of sexual assault complaints “fall into the category of ‘we were both drunk.’
  • Under her guidance, the Department of Education and the Department of Justice rescinded guidelines that allowed transgender students to use the bathrooms aligned with their gender identity.
  • In June (2017), an internal memo indicated that the department was scaling back investigations into civil rights violations at public schools and universities. In the two months that followed, the department also closed or dismissed more civil rights complaints than previous administrations had in similar periods of time.
  • DeVos has also led efforts that blocked the Obama Administration’s protections for students attending for-profit colleges. The regulations would have provided debt forgiveness to students defrauded by for-profit colleges and would have cut off funding to for-profit colleges that burdened students with loans while failing to prepare them for gainful employment.

Let’s fast-forward to now. DeVos is once again making waves and headlines as she ponders whether to allow grants from the academic support fund to be used for a highly controversial purpose: guns. The $1 billion Student Support and Academic Enrichment grants is intended for the country’s poorest schools and school districts to use the money toward three goals: providing well-rounded education, improving school conditions for learning and improving the use of technology for digital literacy.

Given the fact that the Every Student Succeeds Act, signed into law in 2015, is silent on weapons purchases, that omission would allow Ms. DeVos to use her discretion to approve or deny any state or district plans to use the enrichment grants under the measure for firearms and firearms training.

In addition, such a move would reverse a longstanding position taken by the federal government that it should not pay to outfit schools with weaponry. It would also undermine efforts by Congress to restrict the use of federal funding on guns.

DeVos is clearly an anomaly, who is ill prepared for the job. She is the first education secretary in the department’s 35-year history to not have been a public-school parent or student. DeVos attended private institutions for both grade school and college, and her four children were educated at private schools, too.

In my view, Betsy DeVos is unqualified, clearly unfit, and obviously too conflicted to serve as the U.S. Education Secretary and who, for all intents and purposes—appears bent on taking down the very institution she’s entrusted with.

School Integration Advocates Highlight Wins and Losses, Possible Capitol Hill Action

Education Week logoResearchers and advocates who support school integration had a message on Capitol Hill Thursday: There are several setbacks to creating integrated schools, but new opportunities as well.

In a panel discussion on integration here hosted by the National Coalition for School Diversity, they highlighted the downside of what they characterized as the Trump administration’s recent U-turn on diversity efforts, court rulings that have undermined local desegregation efforts, as well as what they said was the resegregation of America’s schools.

But they also highlighted additional funding for the office for civil rights at the U.S. Department of Education, as well as efforts in Congress to remove barriers to integration efforts.

Action on Capitol Hill to promote integration includes House and Senate education appropriations bills for fiscal 2019 that for the first time since the 1970s removes language barring federal funding from being used for transportation to create more integrated schools.

In addition, Rep. Michael Capuano, D-Mass., plans to introduce legislation after the House August recess that removes a prohibition on using federal education aid for this purpose that’s currently part of the federal General Education Provisions Act.

“The threats that we’re facing right now … are not the same threats as the massive resistance of the 1960s. They are shape-shifting,” said Damon Hewitt, the executive director of the Executives’ Alliance for Boys and Men of Color, who moderated the panel. “They threaten to erase the dream of [Brown v. Board of Education].”

The Obama administration put diversity and integration center stage in education policy debates, especially during the latter stages of Barack Obama’s presidency. Then-Secretary of Education John B. King Jr. said schools that are diverse and socioeconomically integrated can be education powerhouses. And in late 2016, the Obama administration announced a $12 million grant competition to help schools boost diversity.

However, the Trump administration has a very different approach to these issues. It scrapped that $12 million grant program, for example. And more recently, the Trump Education and Justice Departments withdrew Obama-era guidance on racial diversity in education because they said it went beyond what the Constitution requires—advocates at the panel singled out that move in particular for criticism.

Following the Marjory Stoneman Douglas High School mass shooting, courageous and inspiring students around the country are demanding action, refusing to believe that we can do nothing to stem America’s gun violence epidemic. In stark contrast, U.S. Secretary of Education Betsy DeVos has responded with plans to chair a new task force on school safety that will, among other things, consider the wholly nonresponsive goal of repealing Obama-era discipline guidance.

The departments of Justice and Education, whose civil rights units we had the privilege to lead during the Obama administration, crafted the 2014 guidance documents that are now under attack. Intended to help schools serve students more effectively, the guidance explains long-standing federal law prohibiting racial discrimination in school discipline and concretely outlines how schools can satisfy this law while maintaining classroom peace. The guidance makes clear to school administrators and communities what the law is and how to apply it to treat all students fairly. In addition, the guidance provides practical resources to reduce disparities in exclusionary discipline and improve school climate, including a 50-state compendium of laws related to school discipline. A best practices document highlights alternatives to out-of-school disciplinary techniques that work to maintain classroom peace. The goal was simply to ensure that all children have a chance to learn and thrive.

The reality is, many American schools have a problem: separate and unequal discipline practices that discriminate on the basis of race. We know from careful investigations we oversaw at the departments of Justice and Education that children of color and those with disabilities often receive harsher disciplinary interventions than their white and nondisabled counterparts—for the same offenses. In one investigation, school staff could not identify nondiscriminatory reasons for racially different disciplinary treatment of students in more than a quarter of the files investigated…

Education Week logoWith the 2018-19 school year in full swing, U.S. Secretary of Education Betsy DeVos has finished approving nearly every state’s plan to implement the Every Student Succeeds Act. But in some ways, the federal government’s work on ESSA is just beginning.

The federal K-12 law’s hallmark may be state and local control, yet the Education Department still has the responsibility to oversee the more than $21 billion in federal funding pumped out to states and districts under ESSA. That will often take the form of monitoring—in which federal officials take a deep look at state and local implementation of the law.

And the department has other oversight powers, including issuing guidance on the law’s implementation, writing reports on ESSA, and deciding when and how states can revise their plans.

Even though ESSA includes a host of prohibitions on the education secretary’s role, DeVos and her team have broad leeway to decide what those processes should look like, said Reg Leichty, a co-founder of Foresight Law + Policy, a law firm in Washington.

Given the Trump team’s emphasis on local control, “I think they’ll try for a lighter touch” than past administrations, Leichty said. But there are still requirements in the law the department must fill, he added.

“States and districts shouldn’t expect the system to be fundamentally different [from under previous versions of the law.] They are still going to have to file a lot of data,” Leitchy said.

But advocates for traditionally overlooked groups of students aren’t holding their breath for a robust monitoring process, in part because they think the department has already approved state plans that skirt ESSA’s requirements…

Arkansas, California, Oklahoma, Pennsylvania, and Texas need to make some big improvements to their plans to implement the Every Student Succeeds Act, according to letters released publicly Friday by the U.S. Department of Education.

The most important letter is probably California’s. It’s a huge population center, and its plan, which relies on a dashboard to track school accountability, is either one of the most innovative and holistic in the country or one of squishiest and most confusing, depending on who you talk to.

The feds gave the Golden State a long, long list of things to fix. For one thing, the department says, it’s not at all clear from California’s plan that academic factors (like test scores) will count for more than school quality factors (like discipline data), an ESSA requirement. California wants to handle schools with low test participation by simply noting the problem on the state’s dashboard. The feds aren’t sure that meets the law’s requirements. And California told the department that it plans to finalize its method for identifying the lowest-performing schools in the state in January of 2018. The feds say they need it explained before they can greenlight California’s plan.

California also doesn’t have clear “interim” or short-term goals for English-language proficiency. It’s also unclear how the state will calculate suspension rates, which California wants to use to gauge school quality and student success. The state also needs to better spell out how it will make sure disadvantaged children get access to their fair share of effective teachers.

California has a long history of bucking the department. The state faced off with the Obama administration on student data systems, teacher evaluation, and more. So it will be interesting to see how many of these changes California makes, €”and whether the state will be approved even it doesn’t significantly revise its plan. A number of states that turned in their plans this spring didn’t make changes the department asked for, €”and got the stamp of approval anyway…

Throughout the past year, we have heard broad assertions that U.S. public schools are failing low-income children, suggestions that teachers are a major part of the problem, and pledges from President Donald Trump and U.S. Secretary of Education Betsy DeVos to fix the problem in a business-like manner.

Missing from all of these discussions—and from many similar ones under former education secretary Arne Duncan—is a fundamental truth. Namely, that all children need, and will thrive, if provided with certain basic resources and supports. And, as a corollary, that education policymakers should not design programs suited to “those children,” but rather advance strategies that ensure equal opportunities, and experiences, for all our children.

As brain research documents, every child begins to learn at birth. The problem that many children and their schools face is that the resources needed to maximize that learning are unevenly distributed. While most professional parents have jobs that provide paid maternity leave, which enables them to bond with their new babies, working-class and poor parents rarely do, and our narrow federal laws do not help. Low-income and working class parents also often struggle to afford safe, stable child care, let alone the stimulating, enriching early education that will prepare children for kindergarten. This results in enormous income-based gaps in school readiness.

Obama Education Appointees: Where Are They Now?

The Obama administration’s political appointees may have cleaned out their desks at the U.S. Department of Education and the White House six months ago or more. But that doesn’t mean that they have stopped working on K-12 policy.

Many of the folks who ran Race to the Top, oversaw waivers from the No Child Left Behind Act, or helped implement the School Improvement Grant program, are still at jobs inside the Beltway, working in state education agencies, or school districts. Many have ended up at the same think tanks, non-profits, and philanthropic organizations. (The Center for American Progress was a popular landing site.) They’ve even got an informal alumni network, and a website, Education 44.

And in general, they seem to be continuing to champion the same kinds of policies they worked on during the Obama years. Think college access, equity, and innovation, often with a technological twist…
